  • These Terms and Conditions are binding and enforceable against every person (“you” or “your“) that accesses or uses this Website and/ or purchases products from Artfrofest Online Store Ltd.
  • This website can be accessed at artfrofest.com and is owned and operated by Artfrofest.
  • By using the Website and by clicking on the “I Accept” button on the Website, as may be applicable, you acknowledge that you have read and agree to be bound by these Terms and Conditions.
  • If there is any provision in these Terms and Conditions that you do not understand, you may click on the “Contact Us” link and request that Artfrofest explain it to you before you accept the Terms and Conditions or continue using the Website.
  • Nothing in these Terms and Conditions is intended or must be understood to unlawfully restrict, limit or avoid any right or obligation, as the case may be, created for either you or Afrofest in terms of the OEC.
  • Artfrofest permits the use of this Website subject to these Terms and Conditions. By using this Website in any way, you shall be deemed to have accepted all the Terms and Conditions unconditionally. You must not use this Website if you do not agree to these Terms and Conditions.

      Use of Website

  • By using the Website you warrant that you are 18 (eighteen) years of age or older and of full legal capacity. If you are under the age of 18 (eighteen) or if you are not legally permitted to enter into a binding agreement, then you may use the Website only with the involvement and supervision of your parent or legal guardian. If your parent or legal guardian supervises you and gives his/her consent, then such person agrees to be bound to these Terms and Conditions and to be liable and responsible for you and all your obligations under these Terms and Conditions.
  • You agree that you will not in any way use any device, software or other instrument to interfere or attempt to interfere with the proper working of the Website. You also agree that all content including any material, information, data, software, icons, text, graphics, lay-outs, images, sound clips, advertisements, video clips, trade names, logos, trade-marks, designs and service marks which are displayed on or incorporated in this Website (the “Content”) belongs to Artfofest and you shall not therefore in any way use any robot, spider, other automatic device, or manual process to monitor, copy, reverse engineer, distribute or modify the Website or the information contained herein, without the prior written consent from Artfrofest.
  • You may not use the Website to distribute material which is defamatory, offensive, contains or amounts to hate speech or is otherwise unlawful.
  • You may not in any way display, publish, copy, print, post or otherwise use the Website and/or the information contained therein without the express prior written consent of Artfrofest.
  • Adding an item to a cart does not reserve the product. While shopping products may become unavailable due to ongoing purchases and as a result may be removed from your cart to avoid checking out a unit that is no longer in stock.

     Ordering Artworks

  • When you place an order for a product, your order is subject to product availability. You acknowledge that stock of all products on the Website is limited and that pricing may change at any time without notice to you. Artfrofest will take all reasonable efforts to monitor stock levels and ensure that when stock is no longer available, that offers thereof are removed from the Website. Artfrofest cannot guarantee the availability of stock. If you order a product on the Website and that product is no longer available after payment, Artfrofest will notify you and you will be entitled to a refund of any amount already paid by you for such products.
  • Prior to delivery or your collection of the products you ordered; you may cancel an order at any time provided you do so before receiving a dispatch notice e-mail from the Artfrofest. After delivery or your collection of the products, you may return such products only in accordance with the Artfrofest Returns Policy.
  • Before you make payment on the Website, you will have the opportunity to review any order for products that you have ordered.

     Payments

  • Secure payment by credit card (CB, Visa, Mastercard and Amex) *
  • Payment by credit card in 4 installments:
    No added fees on any purchase between €100 and €5,000 thanks to our partner Alma. This method is available for buyers whose credit card has been issued in France, Belgium, Germany, Netherlands, Ireland, Austria, Luxembourg, Italy and Spain. To take advantage of this means of payment, you must use CB, Visa, Mastercard or American Express.
    The payment of your order will be spread out over 4 months (1st immediate payment, followed by 3 payments at 1-month intervals).
    Simply select the “payment 4x without fees” (credit card)” option and follow the instructions. Please note that Alma might ask you for proof of ID, this is completely normal and should not be alarming.
    Your order will be placed per usual.
  • Buy now, pay in 15 days:For all orders between €100 and €2000, ARTFROFEST allows you to buy now and pay in 15 days. This is available for all credit card orders placed through our partner Alma. You can pay with your CB, Visa, Mastercard, or American Express card. To use this payment method, choose “Pay in 15 days” and then follow the instructions. Our service provider may request supporting documentation to confirm your identity.As soon as your payment is received, your order will be prepared for shipment!
  • Bank transfer payment: We accept bank transfer payments from all countries. You may pay by bank transfer by sending the total amount to the IBAN we provide.
 

    Return and Refunds Policy

  • For all orders placed in the EU, If you are not completely satisfied with the work you have received, you have 14 days from the date of receipt of your order to cancel and receive a full refund. In this case, ARTFROFEST will pay for the shipping costs to return the artwork. Please keep in mind that commission works cannot be returned.
  • For any order delivered outside the European Union (including DOM-TOM):
    You are responsible for the return shipping costs.
  • We make every effort to ensure that your works are delivered in excellent condition, both in terms of their protection during shipment and the transport itself. Despite all of these precautions, a work may arrive damaged or not conforming to its description.
  • These cases are extremely rare, but if you do find yourself in this situation, ARTFROFEST has solutions. If you find that the work delivered does not conform to its online description (i.e., has a defect or is damaged) you must immediately inform ARTFROFEST via email at ifedolapo@artfrofest.com . Please indicate the nature of the defect or the extent of the damage and send us any relevant information, including pictures. ARTFROFEST will immediately inform the artist and organize for the work to be returned.
    ARTROFEST will arrange for the work to be collected from your home or workplace, whichever is most convenient for you. ARTFROFEST will also cover all return shipping costs within the European Union. Simply wrap the work in its original packaging, including the invoice and certificate of authenticity that were received in the original package.

     Shipping Policy

  • ARTFROFEST ships to France and around the world through our logistics partners. Each work is packaged by the artist according to exact specifications to ensure optimal protection during transport.
  • ARTFROFEST will choose the best-suited carrier based on the nature of the work. Every shipment is tracked and insured. Shipping costs are calculated automatically based on the country of destination and the size of the artwork.
  • We will notify you via email once your order has been sent out. If you receive a damaged product, ARTFROFEST will pay for the return shipping and will oversee the compensation procedures for both the customer and the artist. If a work cannot be repaired or restored, the customer is refunded immediately.
  • Each work of art is packed by the artist in accordance with the very specific specifications provided by ARTFROFEST in order to ensure optimal protection during transport.
  • Over the years, the ARTFROFEST team has gained extensive knowledge of the conditions under which a work of art can be transported. We select the most appropriate carrier for the type of work for each work order, with safety as our top priority. Our logistical team keeps track of each shipment.
  • We use carriers like DHL and Chronopost. We use carriers that are specialized in shipping large works of art.
  • You will be able to track your package’s progress using the tracking link provided.
  • Our packages are delivered to you in person and require a signature. If you are unavailable for delivery, a notice will be left directing you to the post office or the nearest collection point, depending on the carrier.
  • If you order multiple works by the same artist, they will be delivered in one or two parcels, depending on the work’s specifications. If you order multiple works by different artists, each piece will be delivered separately, with its own tracking number.
  • If you order works by multiple artists, they will be shipped separately.
  • As a result, they may arrive at different times and with different carriers. This implies that shipping costs will vary.
  • When you enter your shipping address during checkout, you will see the amount of the delivery charges.
  • All shipments outside of the EU may be subject to a Value Added Tax (VAT). Visit our Customs page or contact us for more information on VAT rates.
  • Import duties and customs fees will apply to any orders shipped outside of the European Union. These fees are beyond the control of ARTFROFEST. They must be paid directly to the transporter, who will contact you either before or after the delivery of your order.
  • If you want to know how much you’ll have to pay before you place your order, please contact your local customs agent, who will be able to tell you the applicable rate.
  • BREXIT: As of January 1, 2021, the United Kingdom will no longer be a member of the European Union. Customs formalities at the border have been restored. If you live in the United Kingdom, you must pay VAT. VAT is 20% of the total price of the goods for original works of art.
  • You will not have to pay customs fees if you live in the European Union.
  • You can change the delivery address or correct an error after placing your order by contacting our customer service team.
  • We can make these changes for you at no extra charge if your order has not yet been shipped.

  • In the event of a change of address, ARTFROFEST shall not be held responsible for any delay in delivery.
